Policy on manufacturer’s defects and ICBC’s attempt to subrogate against those responsible for the issue.

Policy Detail

The material damage (MD) research coordinator must be notified regarding any claim where:

  • a manufacturer’s defect is the cause of loss, or
  • there is a potential warranty recall issue.
In such cases, the MD research coordinator reviews the claim and work with Transport Canada.
Note: When it appears that a manufacturer’s defect is the cause of the loss, ICBC attempts subrogation against those responsible. To be successful, sufficient evidence must be collected to establish liability. The MD research coordinator must be informed in all such cases.
