Determine coverage for an uninsured parked vehicle

A claim owner or exposure owner determines if coverage is available for damage to an uninsured vehicle that was parked when struck by an ICBC insured vehicle. For claims with a date of loss (DOL) on May 1, 2021, or later.

Prerequisites

The registered owner (RO) or lessee of an uninsured vehicle has reported vehicle damage to their parked vehicle, as a result of being struck by the driver of the third party vehicle that is insured by ICBC.

When this applies

When a RO or lessee reports a claim for damage to their uninsured parked vehicle, a claim owner or exposure owner must determine if coverage is available for the parked uninsured vehicle by confirming

Procedure

  1. Determine if the loss location was on a highway.
    Note: As per section 173 of the Insurance (Vehicle) Act, the vehicle damage lawsuit ban does not apply to a claim occurring off highway, if the crash does not involve at least two licensed and insured standard motor vehicles.

    on-highway

    no coverage is available for the uninsured parked vehicle damage, due to the lawsuit ban. Advise the customer that no coverage is available.

    off-highway coverage may be available. Proceed to step 2.
  2. Determine responsibility, and advise the customer of the results.
    Note: For additional information, refer to Responsibility assessments.

    the uninsured parked vehicle damage has coverage from the responsible motorist's Third Party Liability coverage.

    not responsible

    no coverage is available for the uninsured parked vehicle damage,

    Note: The RO or lessee of an uninsured vehicle parked off highway, may have a Third Party Liability claim against the responsible vehicle that struck their vehicle, if the third party vehicle was licensed and insured when they struck the uninsured parked vehicle.
  3. Check if the third party has reported a claim for this loss.
    If a third party (responsible motorist) ... Then ...

    Note: For additional information, refer to Associations
    did not report start a Statutory claim for the RO or lessee's parked uninsured vehicle.
  4. open a Towing - No Own Damage exposure, and set the reserves for the uninsured parked vehicle claim.
    Note: The portion of the vehicle repair or replacement that the responsible motorist is not responsible for, is
    • paid against the Towing - No Own Damage exposure, and
    • transferred to the responsible motorist's Third Party Liability exposure by financial distribution.
